Terms of sale

These terms govern every order placed on this website. Please read them before you buy — placing an order means you accept them.

1. Who you are contracting with

This store trades as Hengate. The seller, and the party you form a contract with, is:

A private company limited by shares, incorporated in the Hong Kong Special Administrative Region and entered on the Companies Registry.

2. Who we sell to

We sell to consumers with a delivery address in Australia. You must be at least 18 years old and legally able to enter into a contract. We do not currently ship anywhere else.

3. Prices

All prices are shown in Australian dollars (AUD) and are the total you pay. Shipping is free, so the price on the product page is the price at checkout.

Cankaya Limited is not currently registered for Australian GST, as our Australian turnover is below the A$75,000 threshold. No GST is charged and no GST tax invoice can be issued. If we register, prices on this site will be updated to be GST-inclusive from that date.

We display one price and we charge that price. We do not show a struck-through “recommended retail price” or a “was” price that we have not genuinely and recently charged, because doing so would mislead you and would breach the Australian Consumer Law.

4. How the contract is formed

Adding an item to your cart is not an order. When you complete checkout you make an offer to buy. We accept that offer — and the contract comes into existence — when we send you an order confirmation email. If we cannot fulfil your order, we will tell you promptly and refund you in full.

5. Errors

If an obvious pricing or description error appears on the site and you order at that price, we are not obliged to supply at the erroneous price. We will contact you, offer you the correct price, and refund you in full if you do not want to proceed. We will not silently ship something different from what was described.

6. Payment

Payment is taken at checkout through Shopify's payment processing. We never see or store your full card number. Your order is dispatched once payment has cleared.

7. Delivery

Delivery terms, timeframes and the origin of shipment are set out in our Shipping policy, which forms part of these terms. In summary: dispatch in 1–2 business days, delivery in 7–11 business days, free, tracked, shipped from our supply partner's warehouse in China, with no duty or customs charge payable by you.

Risk in the goods passes to you on delivery to the address you gave us.

8. Returns, faults and your consumer guarantees

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

9. Using the product safely

The Hengate coop door is a timer-operated door. It has no light sensor, and it must not be relied on to detect an obstacle in the doorway. It opens and closes at the two times you programme, and nothing else. You are responsible for setting a closing time that suits your flock's roosting habit, and for checking that behaviour over the first few evenings after installation. Please read the product page and the instruction sheet before installing.

The unit is designed for mounting on a sheltered coop wall. It is not designed for full exposure to driving rain, for use as a security device, or for any purpose other than controlling access to a poultry coop.

10. Our liability

We are liable to you as the Australian Consumer Law provides, and we do not attempt to contract out of it. Where the law permits us to limit liability, our liability for any claim is limited to replacing the goods, supplying equivalent goods, or refunding the price you paid — whichever we choose, and subject always to your right to choose the remedy where there has been a major failure.

We are not liable for loss that was not reasonably foreseeable, or for loss arising from your failure to follow the instruction sheet or from modification of the product.

11. Intellectual property

The Hengate name, the site design, the text on this site and the product photography as arranged here are ours or licensed to us. You may not copy them for commercial use without our written consent.

12. Privacy

How we handle your personal information — including the fact that it is transferred outside Australia in order to fulfil your order — is set out in our Privacy policy.

13. Complaints and disputes

Contact us first at contact@hengate.com: most problems are solved in one exchange of messages. If we cannot resolve it, you may contact the Australian Competition and Consumer Commission or the consumer affairs or fair trading body in your State or Territory. Nothing in these terms prevents you from doing so.

14. Governing law

These terms are governed by the law of Hong Kong SAR. This does not deprive you of the protection of the mandatory consumer laws of Australia, including the Australian Consumer Law, which continue to apply to you in full, and you may bring proceedings in the Australian courts.

15. Changes

We may update these terms. The version in force is the one published on this page at the moment you place your order, and changes are not applied retrospectively to orders already placed.
